The deal between you and us.

Accepting these terms

By using TheChattyAI website, demo, or paid service, you agree to these terms. If you're using TheChattyAI on behalf of a business, you confirm that you have authority to bind that business.

Demo limits

• Free for evaluation. The in-browser demo and the "call my phone" demo are free to try. They are not for production use, automated testing, or training models.
• Rate limits. 40 requests per ten minutes per IP. Three phone callbacks per phone number per ten minutes. Three concurrent live demo streams per IP. We reserve the right to tune these.
• Quality. The demo runs on third-party voice providers. Audio quality, latency, and availability depend on those providers. We aim for a good experience, not a guaranteed one.
• Session retention. Demo conversations are retained so we can improve quality. Email us to delete any session.

Paid service

• Onboarding. Paid service starts after a recorded onboarding call where we customize Luna, Lucy, and Aria to your business. We aim to have you live within 24 hours of that call.
• Billing. Monthly subscription, billed via Stripe. Your card is charged on the day you go live and on that calendar day each month thereafter.
• No multi-month contract. You can cancel from your dashboard or by emailing us. Cancellation stops the next billing cycle. We don't pro-rate partial months.
• Plan changes. Upgrades take effect immediately, billed pro-rata. Downgrades take effect at the next billing cycle.
• Refunds. If something is broken on our end and we can't fix it, email us within seven days and we'll refund the affected period. We don't refund "I changed my mind" cancellations after a billing cycle has run.

Your content

Anything you provide (call transcripts, customer details, business preferences, logos) remains yours. You grant us a license to process this content solely to operate the service for you. We don't sell, rent, or repackage your content.

Acceptable use

Don't use TheChattyAI to do things that are illegal, harmful, deceptive, or that violate someone's rights. Specifically:

• No spam, mass robocalling, or unsolicited outbound calls outside of opted-in customer relationships.
• No impersonation of a person or business.
• No misuse for unlawful collection, debt-recovery in violation of FDCPA, or other regulated activities you're not licensed for.
• No attempts to evade rate limits, scrape, or reverse-engineer the service.
• No use of demo accounts to handle real customer calls in production.

We may suspend or terminate access for violations.

Voice calls and recording

TheChattyAI handles inbound and outbound phone calls. By using the service you agree that:

• You are responsible for compliance with your jurisdiction's call-recording laws (e.g., one-party vs. all-party consent states).
• Luna and Lucy will identify as AI when a caller asks. You agree not to instruct them to deny it.
• Calls may be recorded and stored in encrypted form for quality, training, dispute resolution, and the audit trail you and we both rely on.

No warranty

TheChattyAI is provided "as is." We don't warrant that the service will be uninterrupted, error-free, or fit for a particular purpose. Voice AI is excellent and improving, but not perfect. Important calls (medical emergencies, legal time-bound matters) should always have a human-verified backup path.

Limitation of liability

Our total liability to you for any claim arising from your use of TheChattyAI is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or punitive damages. Some jurisdictions don't allow this kind of limit; in those, our liability is limited to the maximum extent allowed by law.

Termination

You can cancel any time. We may terminate or suspend an account for non-payment, acceptable-use violations, or by giving you 30 days' notice for any other reason. On termination, you can export your data for 30 days; after that, it is deleted on the schedule described in the Privacy Policy.

Governing law

These terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules. Disputes are resolved in the state or federal courts of Clark County, Nevada.

Changes to these terms

We update these terms as the product and law evolve. We will email customers about material changes at least 30 days before they take effect. Continued use after the effective date means you accept the change.
